RE: DRAFT ROTH IRA CUSTODIAL AGREEMENT FOR REVIEW AND COMMENT

Attached for you review and comment is a draft Roth IRA Custodial Agreement. The
agreement is based on the discussion held at the October 7 meeting of the Roth IRA Ad Hoc
Committee as well as on the House Ways and Means Tax Technical Corrections Act of 1997.
Upon finalization of the draft, the Institute hopes to meet with the IRS and possibly obtain
expeditious approval of the custodial agreement.
