RE: SENATE DROPS ERISA AMENDMENTS FROM BUDGET RECONCILIATION
LEGISLATION

The Institute is pleased to inform you that the Senate today deleted
from the budget reconciliation legislation ERISA amendments designed to
reverse the Supreme Court's decision in Mertens v. Hewitt Associates. As we
previously advised, the amendments were reported out by the Senate Labor and
Human Resources Committee without hearings and would have made significant
changes to ERISA's enforcement provisions. (See Institute Memoranda to
Pension Members Nos. 20-93 and 21-93, dated June 17 and 21, 1993,
respectively.)
Further legislative action on this proposal is expected in the near
future.
