Significant developments since the preparation of the first such survey in 19951 include the protection of IRAs in bankruptcy under Alabama, Idaho, North Carolina and Utah state laws. The Institute prepared this survey based on research of current state legislation and reported bankruptcy opinions. The survey is, however, only a brief summary of legal principles and standards, and further investigation or consultation with counsel is recommended. Additionally, please be aware that whether and to what extent IRAs are protected from creditors in bankruptcy proceedings is a particularly active issue in both the state legislatures and the courts.
