May 27, 1993 TO: PENSION COMMITTEE NO. 18-93 RE: INSTITUTE SUBMISSION TO DEPARTMENT OF LABOR CONCERNING DISCLOSURE REQUIREMENTS UNDER SECTION 404(c) OF ERISA __________________________________________________________ Attached is a copy of the Institute's submission to the Department of Labor requesting an information letter concerning the final regulation under section 404(c) of ERISA. Specifically, the submission requests confirmation that delivery of a mutual fund's prospectus to a plan participant will satisfy the requirement in section 2550.404c-1(b)(2)(i)(B)(1)(ii) that the participant be provided information concerning the investment objectives and risk and return characteristics of the fund.
