Virtual Joint Meeting of SEC Rules Committee and Chief Information Security Officer Committee

We are pleased to announce that, on November 16, from 11-1 pm ET, ICI will hold a virtual joint meeting of the SEC Rules Committee and the Chief Information Security Officer (CISO) Committee. For the first hour of the meeting, we will be joined by Rob Cohen, a partner at Davis Polk and former Chief of the SEC's Cyber Unit. The remaining hour of the meeting is reserved for ICI member discussion.

The ICI's CISO Committee meets every two months to share information and discuss recent cyber trends regarding threats and mitigation techniques. At the last CISO Committee meeting, there was a strong appetite among members for a presentation by an outside counsel, followed by discussion of the issue of privilege as it applies during a data breach. According to the CISO Committee, there are different viewpoints among attorneys as to how to preserve privilege during a data breach response. Predictably, details of any forensic report/analysis or any related investigative reports are most likely to be the subject of a discovery request. At our November joint meeting, Mr. Cohen will address the factors courts consider in determining whether privilege applies, the timing of bringing in outside parties to the incident response process (e.g., law firm, insurance firm, forensic firm, law enforcement, etc.), as well as communication considerations during a data breach response.

Upcoming Meetings of SEC Rules Committee

Please mark your calendars for meetings of the SEC Rules Committee for the remainder of 2021 and looking ahead to 2022. In the next month or so, we will confirm the time and format for the December meeting and will open registration.
