ICI filed the attached comment letter responding to the Department of Labor’s request for information (RFI) on open multiple employer plans (MEPs).[1] The RFI was issued in connection with a final rule expanding access to MEPs sponsored by employer associations and professional employer organizations.[2] The RFI is intended to further develop the public record on a broad range of issues related to open MEPs (i.e., MEPs adopted by otherwise unrelated employers), including the potential conflicts of interest raised if a commercial entity, such as a financial services firm, could sponsor an open MEP and how to mitigate those conflicts.
